USER AGREEMENT
COPYRIGHT -- I understand and agree that all materials, services and information ("materials") presented on this web site are the property of this web site. I agree not to reproduce, copy, or otherwise duplicate such materials without the express permission of this web site. I further understand that any materials presented on this web site are intended solely for Customer's use of this web site. I understand that while I am welcome to benefit from such materials personally, I agree not to resell, modify and resell, and or repackage and resell the materials. I understand that the foregoing agreement provides the web site provider with rights to the materials above and beyond copyright law.
Refunds, exchanges and replacements
1. KC's Fireworks Displays Australasia will only offer a refund or exchange of a ticket if an event is cancelled. KC's Fireworks Displays Australasia does not offer refunds or exchanges as a result of a change in your personal circumstances, or if the event is rescheduled due to adverse weather conditions or global health crisis. We will reschedule for a date that is appropriate to conduct the event. If we do reschedule to a date that is appropriate to conduct the event, No Refunds will be given unless under extreme situations and agreed upon at the discretion of the Promoter.
Subject to any statutory rights of refund (including, without limitation, the provisions of the Australian Consumer Law), if an event takes place then generally there is no right to a refund or exchange, including where a ticket holder cannot attend because of adverse weather conditions.
2. If an event is cancelled, all liability is limited to the amount for which the ticket was purchased (including any fees or charges). Proof of purchase may be required for any refund or exchange. KC's Fireworks Displays Australasia will not be liable for any other losses incurred by you as a result of the cancellation of an event, including any travel and accommodation expenses.
Cancelled Events
1. Occasionally, events are cancelled or postponed by the Event Partner due to weather conditions or other situations which may affect the performers, staff or audience. If an event is cancelled, please contact KC's Fireworks Displays Australasia for information on receiving a refund. Unless indicated otherwise in relation to a particular event, if an event is cancelled or rescheduled, ticket purchasers will be offered seats at any rescheduled event up to the face value of the original tickets or, if the event is not rescheduled, a refund. Refunds for tickets purchased prior to the date of the original event will be given up to the amount paid for the tickets (including per transaction handling fees) but will normally exclude any delivery fees paid in respect of the tickets. Depending on the circumstances in each case, a partial refund may be given where one day of a multi-day event is cancelled. Contact KC's Fireworks Displays Australasia for exact instructions if an event is cancelled or rescheduled. Please make sure to include/provide your Eventbrite order number so we can expedite your refund (if applicable). If you purchased a ticket at a retail outlet, you will need to return the ticket directly to that retail outlet.
2. It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rescheduled event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify ticket purchasers of the cancellation once we have received the relevant authorisation from the Event Partner. We do not guarantee that ticket purchasers will be informed of such cancellation before the date of the event.
Variations to performances or events
1. KC's Fireworks Displays Australasia reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity. Please Note: No Refunds will be Given unless under extreme situations and agreed upon at the discretion of the Promoter.
2. KC's Fireworks Displays Australasia reserves the right to reschedule an event due to weather conditions or other situations which may affect the performers, staff or audience. KC's Fireworks Displays Australasia will notify patrons via our Facebook Page and on this website.
Authenticity and validity of tickets
1. Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from KC's Fireworks Displays Australasia or other authorised points of sale.
Resale of tickets & scalping
1. Tickets may not, without the prior written consent of KC's Fireworks Displays Australasia, be resold or offered for resale at a premium (including via on-line auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticket holder may be refused admission. KC's Fireworks Displays Australasia will take all reasonable steps to notify you of KC's Fireworks Displays Australasia’s intention to cancel the ticket or render it invalid within a reasonable time before cancelling it or rendering it invalid.
SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.
